1. INTRODUCTION

Welcome to Tharagais (“Platform”, “Tharagais”, “we”, “our”, “us”).

These Terms & Conditions (“Terms”) govern your access to and use of the Platform, including purchase of products, seller participation, and all related services.

By accessing, browsing, registering, or transacting on the Platform, you agree to be legally bound by these Terms, our Privacy Policy, Cancellation & Return Policy, Shipping Policy, and applicable Indian laws.

If you do not agree to these Terms, please do not use the Platform.

2. ELIGIBILITY

3.2 Tharagais is not the manufacturer of products unless explicitly stated.

3.3 Product descriptions, pricing, warranties, guarantees, and after-sales support are the responsibility of the respective Seller.

3.4 Tharagais acts as an intermediary under applicable Indian e-commerce regulations.

4. USER ACCOUNT & RESPONSIBILITIES

4.1 You may be required to create an account to place orders.

4.2 You agree to:

  • Provide accurate and current information
  • Maintain confidentiality of login credentials
  • Accept responsibility for activities conducted under your account

4.3 Tharagais reserves the right to suspend or terminate accounts that:

  • Provide false information
  • Engage in fraudulent activity
  • Violate these Terms

5. PRODUCT INFORMATION & PRICING

5.1 Sellers list products with descriptions, images, and pricing.

5.2 While we strive for accuracy, errors may occur. Tharagais reserves the right to:

  • Correct pricing errors
  • Cancel orders arising from incorrect listings

5.3 Prices are inclusive or exclusive of GST as mentioned on the product page.

6. ORDER ACCEPTANCE

6.1 Placing an order constitutes an offer to purchase.

6.2 Order confirmation does not guarantee acceptance. Orders may be cancelled due to:

  • Stock unavailability
  • Payment failure
  • Fraud suspicion
  • Pricing errors
  • Force majeure

6.3 Refunds for prepaid orders will be processed in accordance with the Refund Policy.

7. PAYMENTS

7.2 Payment processing is handled through secure third-party gateways.

7.3 Tharagais does not store complete card details.

7.4 In case of payment disputes, platform records shall be considered prima facie evidence.

8. SHIPPING & DELIVERY

8.3 Risk of loss transfers to the customer upon successful delivery.

9. CANCELLATION, RETURNS & REFUNDS

9.2 Return windows vary by product category and are governed by the Cancellation & Return Policy.

9.3 Refunds are subject to quality inspection and may take 5–7 business days for processing.

9.4 Certain items such as customized products, personal hygiene products, and perishables may not be returnable.

10.2 You grant Tharagais a non-exclusive, royalty-free, perpetual license to use such content.

11. INTELLECTUAL PROPERTY

All content on the Platform, including:

  • Logos
  • Branding
  • Graphics
  • Layout design
  • Software

are owned by or licensed to Tharagais and protected under applicable intellectual property laws.

Unauthorized use is strictly prohibited.

12. PROHIBITED USE

You agree not to:

  • Use the Platform for unlawful purposes
  • Attempt unauthorized access
  • Interfere with transactions
  • Introduce malicious software
  • Abuse promotional offers

Violation may result in account termination and legal action.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Tharagais shall not be liable for indirect, incidental, or consequential damages.
  • We are not liable for seller misconduct or product defects.
  • Maximum liability shall not exceed the value of the concerned transaction.

14. INDEMNITY

You agree to indemnify and hold harmless Tharagais, its directors, employees, affiliates, and agents against claims arising from:

  • Breach of these Terms
  • Violation of law
  • Infringement of third-party rights

15. FORCE MAJEURE

Tharagais shall not be liable for failure or delay due to events beyond reasonable control, including:

  • Natural disasters
  • Government restrictions
  • Strikes
  • Logistics disruptions

16. TERMINATION

We may suspend or terminate access:

  • For violation of Terms
  • For fraudulent activity
  • At our discretion with reasonable cause

Users may discontinue use at any time.

17. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.

Any dispute shall be subject to the exclusive jurisdiction of courts located in Pondicherry, India.

18. CHANGES TO TERMS

Tharagais reserves the right to update these Terms at any time.

Continued use of the Platform after updates constitutes acceptance of revised Terms.
