This Cancellation, Return and Refund Policy (“Policy”) governs purchases made on the Tharagais platform (“Platform”). Tharagais operates as a curated multi-vendor marketplace under Agam Creative Studio. By placing an order on the Platform, you agree to be bound by this Policy.
This Policy shall be read in conjunction with the Terms of Use and Privacy Policy available on the Platform.
1. Nature of Platform
1.1 Tharagais is an online marketplace that facilitates transactions between buyers and independent third-party sellers (“Sellers”).
1.2 Tharagais is not the manufacturer of products listed on the Platform unless explicitly stated.
1.3 Return, replacement, exchange and refund decisions may involve the respective Seller, and in certain categories, the brand or manufacturer.
1.4 The policy displayed on the respective product page shall prevail over this general Policy in case of any conflict.
2. Order Cancellation Policy
2.1 Cancellation by Customer
- a) An order may be cancelled any time before it is dispatched.
b) Once the order status is marked as “Out for Delivery,” cancellation shall not be permitted.
c) The customer may refuse delivery at the doorstep; such refusal shall be treated as cancellation.
d) Cancellation windows may vary based on product category and shall be as mentioned on the product page or order confirmation page.
e) In certain cases, a cancellation fee may apply after the permissible cancellation window has expired.
2.2 Hyperlocal / Express Orders
Orders placed under same-day, hyperlocal or express delivery options may be non-cancellable and non-refundable due to rapid fulfillment timelines.
Exceptions may apply in the following cases:
- Order not accepted by Seller
- Order not picked up by delivery personnel
- Failure to deliver within committed timeline
- Any other reason as determined by Tharagais at its discretion
2.3 Cancellation by Tharagais or Seller
Tharagais or the Seller reserves the right to cancel any order, in whole or in part, for reasons including but not limited to:
- Product unavailability
- Incorrect pricing or listing errors
- Suspected fraudulent transaction
- Violation of Terms of Use
- Force majeure events
- Logistical or operational constraints
In such instances, no charges shall be levied for the cancelled order. Any prepaid amount shall be refunded within 5–7 business days.
3. Return Policy
Returns are subject to product category, Seller-specific terms, and eligibility criteria mentioned on the respective product page.
Return eligibility shall be determined from the date of delivery.
3.1 Category-Based Return Windows
The following general return windows apply unless otherwise specified on the product page:
- Apparel, Fashion & Footwear – 10 Days (Refund / Exchange / Replacement)
- Home Décor & Furnishings – 7 Days (Refund / Replacement)
- Books – 7 Days (Replacement Only; damaged/wrong item)
- Toys & Stationery – 7 Days (Replacement Only; defective/wrong item)
- Sustainable Handmade Products – 5–7 Days (Replacement Only; manufacturing defects only)
- Electronics (Small Appliances) – 7 Days (Replacement Only; subject to brand verification)
- Large Appliances & Furniture – 10 Days (Replacement Only; installation by authorized personnel required)
- Grocery – Non-Perishables – 3–7 Days (Refund Only; damaged/expired/wrong item)
- Fresh & Perishables – 24–48 Hours (Refund Only; quality complaints only)
Only one replacement per product shall be provided, unless otherwise required under applicable consumer protection laws.
4. Conditions for Return Acceptance
Return requests shall be subject to verification at the time of pick-up and quality check.
The following conditions must be satisfied:
4.1 Correct Product
- Product must match invoice details, serial number, SKU, or IMEI (where applicable).
- MRP tag and brand tags must remain intact.
4.2 Complete Product
- All accessories, manuals, warranty cards, and complimentary items must be returned.
4.3 Unused Condition
- Product must be unused, unwashed, and free from stains, damage, or wear.
- Seals, return tags, and warranty labels must not be tampered with.
- Electronic devices must be formatted and unlocked before return.
4.4 Original Packaging
- Product must be returned in its original packaging without significant damage.
Failure to meet these conditions may result in rejection of the return request.
5. Non-Returnable Products
The following categories are generally non-returnable due to hygiene, customization, or nature of product:
- Innerwear, socks, and intimate wear
- Personal hygiene and wellness products
- Customized or personalized products
- Perishable goods beyond permitted window
- Products with minor handmade or artisanal variations
- Intimate care and sanitary products
However, damaged, defective, expired, or incorrect products in these categories may be eligible for replacement or refund upon verification.
6. Refund Policy
6.1 Refunds shall be processed only after the returned product passes quality inspection by the Seller.
6.2 Refund timelines:
- UPI / Debit Card / Credit Card / Net Banking – 5–7 business days
- Wallet refunds – 24–48 hours
- Cash on Delivery (COD) – Bank transfer upon confirmation of bank details
6.3 Refund timelines are indicative and subject to banking and payment gateway processing times.
7. Open Box Delivery
If the order is delivered under an open-box delivery option:
- Any damage, missing item, or wrong product must be reported immediately at the time of delivery.
- Once accepted, returns shall not be processed except for verified manufacturing defects.
8. Brand Warranty & Service Center Replacement
Certain categories such as electronics and large appliances may require:
- Brand-level troubleshooting
- Service center diagnosis
- DOA (Dead on Arrival) certificate
In such cases, replacement or repair shall be governed by the brand’s warranty policy.
9. Limitation of Liability
Tharagais acts solely as an intermediary marketplace. Final approval of return, replacement, or refund for defective products rests with the respective Seller or Brand, subject to applicable law.
Tharagais reserves the right to:
- Restrict excessive or fraudulent return requests
- Modify or update this Policy at any time
- Evaluate product condition through authorized representatives
